Digital Millennium Copyright Act Compliance and Intellectual Property Protection

Violation Consequences: Users who engage in copyright infringement may have their accounts terminated and may face legal action.

DMCA Takedown Notice

If you believe your copyrighted work has been used in a way that constitutes copyright infringement, you may submit a DMCA takedown notice.

Required Information

Your takedown notice must include:

  • Identification: Description of the copyrighted work
  • Location: URL or location of the infringing material
  • Contact Information: Your name, address, phone, and email
  • Good Faith Statement: Statement of good faith belief
  • Accuracy Statement: Statement of accuracy under penalty of perjury
  • Authorization: Statement that you are authorized to act

Notice Requirements

Legal Requirement: DMCA notices must comply with 17 U.S.C. § 512(c)(3). Incomplete notices may not be processed.

Your notice must be:

  • In writing and signed
  • Sent to our designated agent
  • Include all required elements
  • Made in good faith

DMCA Counter Notice

If you believe your content was removed due to a mistake or misidentification, you may submit a counter notice.

Counter Notice Requirements

Your counter notice must include:

  • Identification: Description of the material that was removed
  • Location: URL where the material was located
  • Good Faith Statement: Statement of good faith belief
  • Consent: Consent to jurisdiction of federal court
  • Contact Information: Your name, address, phone, and email
  • Signature: Physical or electronic signature
Legal Warning: Submitting a false counter notice may result in liability for damages, including costs and attorney's fees.

Counter Notice Process

  1. Submit complete counter notice to our designated agent
  2. We will review the counter notice for completeness
  3. If valid, we will forward it to the original complainant
  4. The original complainant has 10 business days to file a lawsuit
  5. If no lawsuit is filed, we may restore the material

Repeat Infringer Policy

We have a policy for dealing with repeat copyright infringers in accordance with DMCA requirements.

Infringer Identification

We identify repeat infringers based on:

  • Multiple valid DMCA notices
  • Pattern of copyright violations
  • Failure to respond to warnings
  • Continued infringement after takedown

Enforcement Actions

For repeat infringers, we may:

  • Issue warnings and educational materials
  • Restrict access to certain features
  • Suspend accounts temporarily
  • Terminate accounts permanently
  • Block IP addresses if necessary
Appeal Process: Users may appeal enforcement actions by contacting our designated agent and providing evidence of compliance.
